Terms & Conditions
These Terms and Conditions govern your use of the Nilam website and your participation in any Nilam financial education programme. Please read them carefully before submitting an enquiry or enrolment request. By using our website or enrolling in a programme, you agree to be bound by these terms.
1. Definitions
In these Terms and Conditions, the following terms have the meanings set out below:
- "Nilam" / "We" / "Us" / "Our" refers to Nilam, operating from Level 7, Menara Standard Chartered, 30 Jalan Sultan Ismail, 50250 Kuala Lumpur.
- "User" / "You" / "Your" refers to any individual who accesses our website or enquires about or enrols in a programme.
- "Programme" refers to any educational session or course offered by Nilam, including the Credit Essentials Session, Responsible Borrowing Programme, and Credit Literacy Foundations Course.
- "Website" refers to the Nilam website accessible at nilami.pro.
- "Content" refers to all materials, worksheets, publications, and educational resources created and distributed by Nilam.
- "Agreement" refers to these Terms and Conditions as amended from time to time.
2. Acceptance of Terms
By accessing our website or submitting an enquiry or enrolment, you confirm that:
- You are at least 18 years of age.
- You have the legal capacity to enter into a binding agreement.
- You have read and understood these Terms and Conditions and agree to be bound by them.
- If you are using the website on behalf of an organisation, you have authority to bind that organisation.
3. Description of Services
Nilam provides in-person financial education programmes in Kuala Lumpur. All programmes are general educational sessions designed to help members of the public understand credit and borrowing concepts. Nilam:
- Does not provide regulated financial advice under the Capital Markets and Services Act 2007 or any other Malaysian financial services legislation.
- Does not recommend specific financial products, lenders, or institutions.
- Operates as an independent educational provider with no commercial affiliation to any bank or financial product provider.
Programmes are conducted in English at our Kuala Lumpur premises. Session availability is subject to scheduling and minimum enrolment numbers.
4. Programme Enrolment
Enrolment in a programme is confirmed upon receipt of your payment in full. The following conditions apply:
- Enrolment is personal and non-transferable without our prior written consent.
- You are expected to attend in person at the scheduled times and location.
- Nilam reserves the right to refuse or cancel an enrolment if a participant's conduct is likely to disrupt the learning environment for others.
- Programme materials distributed during sessions are for your personal educational use only.
Cancellation and Refunds
- Cancellations made 7 or more days before the programme start date: full refund less an administrative fee of RM 50.
- Cancellations made within 3–6 days before the programme start: 50% refund of the programme fee.
- Cancellations made within 48 hours or non-attendance: no refund, except where Nilam cancels the programme.
- If Nilam cancels a programme, enrolled participants will receive a full refund or the option to transfer to the next available intake.
5. User Responsibilities
You agree to use our website and programme services lawfully and in good faith. In particular, you agree not to:
- Reproduce, distribute, or sell Nilam programme materials without written authorisation.
- Record sessions (audio or video) without prior written consent from Nilam.
- Misrepresent programme content or the nature of Nilam's services to third parties.
- Use our website in any manner that could damage, disable, or impair its operation.
- Submit false or misleading information through our contact or enrolment forms.
6. Intellectual Property
All website content, programme materials, worksheets, toolkits, and reference publications created by Nilam are the intellectual property of Nilam. You are granted a limited, non-exclusive, non-transferable licence to use materials distributed during programmes for your personal educational purposes only. This licence does not permit reproduction, distribution, or commercial use without our written consent.
7. Payment Terms
All programme fees are quoted and payable in Malaysian Ringgit (RM). Current fees are:
- Credit Essentials Session: RM 510 per participant
- Responsible Borrowing Programme: RM 1,580 per participant
- Credit Literacy Foundations Course: RM 4,250 per participant
Payment is due in full prior to programme commencement. Nilam reserves the right to revise fees for future intakes with reasonable notice. Fees already paid for a confirmed enrolment will not be subject to mid-programme increases.
8. Disclaimers
To the fullest extent permitted by Malaysian law:
- Our website and programme content are provided on an "as is" basis without warranties of any kind.
- Nilam makes no representation that attending a programme will lead to any particular financial outcome or decision.
- Content is general educational information only. It is not a substitute for regulated financial, legal, or tax advice. You should consult a licensed professional for advice specific to your circumstances.
- We do not warrant that our website will be uninterrupted, error-free, or free of viruses.
9. Limitation of Liability
To the fullest extent permitted by law, Nilam's total liability to you in connection with these terms or any programme shall not exceed the amount you paid to Nilam for that programme. Nilam shall not be liable for:
- Indirect, consequential, or incidental losses or damages.
- Loss of profit, opportunity, or expected savings.
- Any financial decision or action taken on the basis of programme content.
- Events beyond our reasonable control (force majeure), including natural disasters, public health emergencies, or infrastructure failures.
10. Indemnification
You agree to indemnify and hold harmless Nilam, its staff, and agents from and against any claims, losses, or expenses (including reasonable legal fees) arising from your breach of these terms, your misuse of our materials, or any misrepresentation you make about Nilam's services.
11. Termination
Nilam may terminate your access to the website or remove you from a programme without prior notice if you materially breach these terms. You may stop using our website at any time. Upon termination, all licences granted to you under these terms will cease. Sections 8, 9, 10, 12, and 13 shall survive termination.
12. Dispute Resolution and Governing Law
These Terms and Conditions are governed by the laws of Malaysia. Any dispute arising in connection with these terms shall be subject to the exclusive jurisdiction of the courts of Malaysia.
Before commencing formal proceedings, either party agrees to attempt to resolve any dispute informally by contacting us at [email protected]. We aim to acknowledge such communications within 5 business days.
13. General Provisions
- Entire Agreement: These terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Nilam regarding your use of our services.
- Severability: If any provision of these terms is found to be unenforceable, the remaining provisions will continue in full force.
- No Waiver: Our failure to enforce any provision does not constitute a waiver of our right to enforce it in the future.
- Assignment: You may not assign your rights under these terms without our written consent. Nilam may assign its rights to a successor entity.
14. Changes to These Terms
We may update these Terms and Conditions from time to time. Updated terms will be published on this page with a revised "Last Updated" date. Your continued use of our website or services after changes are posted constitutes your acceptance of the updated terms. We recommend reviewing this page periodically.
